You may have heard some differing opinions on this topic over the years. Many knowledgeable attorneys have given highly differing opinions. On July 1st, we received clarification by way of SF 2300.
The question as to whether the exemption applies comes down to 2 things:
1. Is the fiduciary a living natural person?
2. Did they live in the home at any time within the last 12 months?
This should bring some clarification if you are a homeowner or a real estate agent.
